Bike Fall Gets New Chance to Roll
A bicyclist was riding through the Chicago Park District when his bicycle tire got caught in a large crack in the concrete, causing him to fall. The Chicago Park District claimed it could not be responsible for his injuries because it was immune from suit because the incident took place on a trail. The trial court agreed and dismissed the case.
However, the appellate court disagreed and reversed the trial court in favor of the injured victim. The court found the statute the Chicago Park District was trying to use was able to be interpreted at least two different ways and so it was unfair to rule against the victim.
